  1. Scope of application
    1.1. These General Terms and Conditions (GTC) of German Copters DLS GmbH (hereinafter referred to as German Copters) apply to all contracts for the transport and delivery of goods that a consumer or entrepreneur (hereinafter referred to as customer) concludes with German Copters DLS GmbH. These General Terms and Conditions take precedence over the Customer’s own terms and conditions and individual agreements, even if German Copters does not expressly object to them.
    1.2. A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
    1.3. An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
    1.4. The General Terms and Conditions apply to all contracts, deliveries, and services, including consulting services, other services, information, and similar items.
  2. Contract content/services
    2.1. German Copters transports and delivers the customer’s goods using automated flying drones. The drones used comply with the legally approved standards. The customer has no right to demand transport by a specific model.
    2.2. Transport may only take place on approved transport routes. Special transport routes requested by the customer must be approved by the Federal Aviation Authority.
    2.3. When placing an order, the customer must provide the following information: company name, power of representation, registered office, VAT ID number, contact person, pickup address, destination address, shipping date, description of the goods to be shipped, including weight and volume.
  3. Conclusion of contract/revocation/cancellation
    3.1. The order for the transport of the customer’s goods can be placed by telephone or e-mail. Individual arrangements are possible.
    3.2. The customer will receive an order confirmation. The order confirmation specifies the start of the transport flight, the estimated duration of the flight, and the estimated time of arrival. Without an order confirmation, the contract is not considered concluded and transport is not owed.
    3.3. Transport shall commence immediately after the order confirmation has been issued or at the agreed time.
    3.4. By placing the order, the customer assures that the goods to be transported are complete and undamaged when handed over to German Copters. Loading of the transport container by the customer themselves shall also be deemed to be handover to German Copters.
    3.5. Subscription contracts may be concluded. Subscription contracts are contracts with a minimum order volume of ten transport flights per month. The minimum term of a subscription contract is 12 months and is automatically extended if it is not terminated in good time. In the case of subscription contracts, German Copters guarantees transport even if drones cannot be used
    3.6. The customer can cancel the transport free of charge up to 24 hours before the start.
    3.7. If the customer cancels the order without complying with the above deadline, German Copters may demand up to 100% of the transport fee. The customer is entitled to provide evidence that no damage has been incurred in the amount claimed.
    3.8. German Copters is entitled to cancel the contract if the customer has not provided all the information specified in section 2.3 or has provided incorrect information.
  4. Loading the drone/transporting the goods
    4.1. German Copters provides transport containers for the goods to be transported. The goods to be transported must be loaded into the drone in packaging suitable for transport and storage using this transport container.
    4.2. If it is possible to fly the drone directly to the customer’s location, the customer can load the drone themselves according to instructions. The same applies to the removal of the goods to be transported.
    4.3. If a direct flight to the customer’s location is not possible, German Copters will load the goods at the company’s location or at the drone’s location. The goods to be transported must then be delivered by the customer to the respective location.
    4.4. If the customer is unable to bring the goods to be transported to the location, German Copters will collect the goods from the customer.
    4.5. If the customer is unable to unload the goods themselves at the destination, German Copters will carry out the unloading and deliver the goods to the destination by car. The client is obliged to hand over the goods to German Copters in packaging suitable for transport and storage.
  5. Dangerous goods
    Dangerous goods, people, or animals cannot be transported. The transport of items that may pose a danger—e.g., sharp, pointed, or flammable goods—is prohibited and therefore not carried out by German Copters.
  6. Liability
    6.1. German Copters, its vicarious agents, legal representatives, and representatives shall be liable for damage to or loss of the transported goods insofar as the damage or loss is due to a defect in the drone, a flight error, or an unforeseeable event (crash, shooting down, etc.).
    6.2. German Copters shall only be liable for delays or the impossibility of transport to the extent that the delay or impossibility is due to an obstruction on the transport route which German Copters should have been aware of. German Copters shall not be liable for unforeseeable obstacles, including exceptional weather events.
    6.3. Otherwise, liability is excluded.
    6.4. The customer shall be liable for damage to the drone or damage to third-party property insofar as the damage is due to improper loading of the drone by the customer, exceeding the maximum weight, tampering with the drone, changes to its condition, or loading that violates Section 5 of the General Terms and Conditions.
    6.5. The customer is liable for delays in transport or the impossibility of transport insofar as the delay or impossibility is due to inaccurate address information for the pick-up and destination provided by the customer.
    6.6. The customer must report any damage to the drone or the transported goods, as well as the loss of the transported goods, to German Copters immediately after becoming aware of it, but no later than 24 hours after becoming aware of it.
  7. Prices and terms of payment
    7.1. Prices are agreed individually upon conclusion of the contract.
    7.2. Payment is due upon conclusion of the contract.
    7.3. Payment can be made in cash upon delivery or collection of the goods at the respective location, by instant bank transfer, or by bank transfer.
  8. Final provisions
    8.1. The general and specific place of jurisdiction is Dresden.
    8.2. In addition to these General Terms and Conditions, the German Air Traffic Regulations (LuftVO) and the EU Drone Regulation in their currently valid versions apply.
